Property.io Ltd Short & Mid-Term Rental Guest Agreement

1. Your Booking

1.1. Your booking with Property.io Ltd ("Property.io") grants you a limited license to enter, occupy, and use the Property during your stay. A confirmation email containing your stay's details will be sent to the email address you provide. Report any issues to a Property.io representative ("Booking Coordinator") and the on-site property manager, where applicable. Complaints made after you leave the Property will not be considered.

1.2. You may be offered third-party services, equipment, or experiences during your stay ("Additional Guest Services"). These are optional, and Property.io and its Affiliates may facilitate bookings on your behalf with your authorization, which can be withdrawn in writing. These third-party providers are independent contractors, not Property.io employees.

1.3. The Property.io Guest Refund Policy, Cancellation Policy, and any pre-booking terms, such as fees, property rules, and taxes, are incorporated into this Agreement.

2. Payments and Security Deposit

2.1. Fees, including accommodation, service, hospitality, taxes, and other specified costs ("Fees"), are outlined before booking. You accept these Fees upon confirmation, and they are charged to the Payment Method you authorize unless otherwise specified. Usage Fees (for certain property features) will be charged post-stay unless agreed upon otherwise.

2.2. Your Payment Method acts as collateral for any damages or unpaid amounts. If a security deposit is required, it will be noted before booking, and you consent to a hold being placed on your Payment Method.

2.3. Any additional agreements between you and the Host, including extra fees, will not affect these Terms.

2.4. Rates for Additional Guest Services will be presented before booking, and all amounts due must be paid at the time of booking the service.

2.5. Credit Cards: The property manager may collect credit card details or pre-authorize your card for incidentals or damages.

3. Use of Property

3.1. You are responsible for complying with all applicable laws and regulations during your stay.

3.2. You and your invitees agree to:

Maintain the Property in its arrival condition.
Follow any house manuals or instructions from the Host.
Not exceed the maximum guest limit without prior written approval. Guests are not allowed beyond the number of guests mentioned in the booking. No visitors or stay-overs are permitted. Each additional guest will be charged £100 per day per guest.
Obtain approval for parties, events, or other gatherings.
Use all facilities (e.g., pool, hot tub) at your own risk.
Comply with the pet policies, with written approval required.

Loud noise or music that can be heard outside the apartment after 9 PM will lead to immediate cancellation and a penalty fee of £300.

3.3. Real estate showings may occur during your stay with prior notice.

3.4. Check-in and Check-out:

Check-in: After 5:00 PM.
Check-out: Strictly by 10:00 AM.

You agree to arrive and leave according to these times unless otherwise agreed upon.

3.5. Property Policies:

Smoking: Strictly NON-smoking (includes vaping, e-cigarettes, and Shisha).
Drugs: Zero-tolerance policy.
Parties: Not allowed. Quiet time between 10:00 PM and 8:00 AM.
Pets: No pets unless agreed, with a fee of 10% of the booking cost.
Subletting: Prohibited.

3.6. Key Handover and Return: Keys are managed via KEYNEST or via a LOCKBOX on site. In case of loss or failure to return any keys, fobs, or permits, we reserve the right to charge £200 per item plus an administrative fee. The keys/fobs/permits must be returned to the original collection location. Keep a photo record of check-in and check-out items.

4. Booking Cancellations, Refunds, and Modifications

4.1. Cancellations are subject to the applicable policies presented before booking. Full refunds are available if canceled within one hour of booking and at least 28 days before check-in. Shorter stays have different cancellation timelines.

4.2. Any booking modifications require approval and may incur additional fees.

4.3. You are responsible for travel documentation and arrangements. Property.io is not liable for any losses due to travel or weather-related issues.

4.4. Refunds or modifications for Additional Guest Services depend on the provider's policies.

4.5. Insurance and Valuables: Property.io does not insure personal belongings. You are encouraged to secure insurance for personal effects.

5. Damages

5.1. You are responsible for any damages, losses, or injuries caused by you or your guests.

5.2. Property.io will notify you of any damage claims made by the Host. If valid, your Payment Method may be charged for damages beyond the security deposit.

6. Force Majeure

Property.io and the Host are not liable for any delays or failures caused by events beyond their control, such as natural disasters or government actions.

7. Limitation of Liability

7.1. To the extent permitted by law, Property.io is not liable for delays, accidents, or injuries during your stay.

7.2. For EU residents, Property.io is only liable for gross negligence or breach of essential obligations. Additional liabilities are excluded.

7.3. Liability will not exceed the greater of the amounts paid to Property.io or £100.

8. Indemnification

8.1. You agree to release, defend, and indemnify Property.io from any claims arising from your stay, use of the Property, or breach of this Agreement.

8.2. You acknowledge that Property.io is not liable for any damages caused during your stay, and you are responsible for indemnifying the company.

9. Dispute Resolution and Arbitration

9.1. Parties agree to resolve disputes through arbitration, governed by the laws of England and Wales.

9.2. Disputes will be subject to arbitration with an authorized provider, and parties waive the right to trial by jury or class actions.

10. SUPERHOG - GUEST AGREEMENT

10.1. Booking Validation: To protect the Host’s interest in the Property, you, the Guest, agree to complete a Booking Validation through SUPERHOG. This may include providing photographic ID for identity verification.

10.2. Third-Party Providers: The Host or SUPERHOG, acting as the Host’s agent, may use third-party providers to carry out ID verification and other checks.

10.3. Liability for Property Damage: You acknowledge that you are liable for all damages to the Property caused by you or your invitees, whether directly or indirectly, during your stay. Unreported damages will be assumed to have been caused by you.

10.4. Photographic Record: You are encouraged to take photographic evidence of the Property upon arrival and departure to provide proof of the Property’s condition.

10.5. Property Use: You agree to:

Use the Property responsibly and only for its intended purposes.
Avoid causing damage to fixtures, appliances, and fittings.
Ensure the Property is secured at all times.
Keep the Property well-ventilated to avoid moisture buildup.

10.6. Chargebacks: You agree not to initiate any chargebacks against the Host or SUPERHOG for any fees owed.

10.7. Notification of Damage: If any damage occurs, you must report it immediately to the Host or SUPERHOG and take reasonable steps to mitigate further damage.

10.8. General Terms: Any notices will be sent via email and are deemed received 8 hours after being sent. This Agreement shall be governed by the laws of England and Wales.

11. General Terms

11.1. Notices to Property.io should be sent to [Property.io's Address], and you will receive notices via email.

11.2. Property.io may terminate this Agreement with 30 days' notice. Immediate termination may occur for significant breaches.

11.3. You cannot assign this Agreement without written consent.

11.4. Guest Access: Only registered guests can stay at the Property. Unregistered visitors will result in immediate cancellation.

Other things to note: No perishables, such as oil, salt, or pepper, are provided.

Booking conditions
